ARBORETUM SWIMMING POOL RULES

 

The following rules have been established for the benefit and protection of all Arboretum members and guests. These rules have been developed for the operation of the pool in the best interest of the resident members of the community and may be changed or amended as necessary. They are established by the Arboretum Homeowner’s Association and approved by the Arboretum Board of Directors to ensure proper operation of the pool and to provide safe and wholesome recreation for members and their guests. Any unforeseen circumstances or situations that are not specifically covered by established rules shall be handled by the Board of Directors, or an authorized representative of the Association. These regulations take precedence over all previously adopted pool regulations. 

To make the pool enjoyable for all, please follow these rules and the ones posted at the pool.  Members and their guests are requested to cooperate in observing the rules; and parents are requested to emphasize to their children the importance of observing the rules. For the safety of all members, there can be No exceptions. 

Availability

Pool Hours: The pool is open from 6:00am until 11:00 pm. 

No person is permitted within the pool enclosure except during regular pool hours.

When a member reserves the pool, the pool will be closed to other members.

Pool Reservations for the exclusive use of the pool shall be restricted to a maximum of three (3) hours. 

Access

Membership to the pool is open to all homeowners of the Arboretum Homeowners Association in good standing; and use of the pool is for Arboretum residents and their invited guests only. 

The clubhouse can be accessed with a magnetic card. The pool’s rear door is to remain locked at all times, and under no circumstances should the door be left open. The Board of Directors shall have the right to close the pool or restrict its use whenever the safety or health of participants is endangered (i.e. contamination. chemical application, or equipment failures). For your safety, please respect any notices to this effect posted by the Board of Directors. 

Clubhouse Cards

No one is to be allowed admittance to the clubhouse without a valid card. A total of one card will be issued per household, and is for your family only. If you should lose a card, you will be provided with a replacement at a charge of $10.00.

Denial of Access

Cards will not be issued and admittance will be denied to homeowners who: Are delinquent in the payment of assessments including interest, late fees, and legal charges.

 Any person having a communicable disease, open blisters or cuts, sore or inflamed eyes, ears, nose or mouth infections, or any type of skin disease should refrain from entering the pool area.

Guests

All Arboretum guests must abide by the same rules and regulations as resident members, and the

Sponsoring member shall be responsible for the conduct of their guest and their guest’s

Compliance with the pool rules and regulations.

 Age Restrictions

A person must be 16 yrs old to use the spa and pool unattended with a maximum of 3 guests 16 yrs. or older.

All children under (16) years shall be supervised by an adult (18 years or older) at all times; such adult will not leave the child unattended at any time. 

General Rules

Showers: All persons are encouraged to shower before entering the pool or spa as sand, sun lotions and body oils can reduce the effectiveness of the pool chemicals.

Animals: No pets are allowed in the pool area with the exception of guide dogs. Guide dogs for the blind will be admitted to the pool area but must be kept leashed.

Inflatable items: Only small inflatable items are allowed in the pool. Oversized tubes and multi-person rafts are prohibited.

Glass: No glass containers are allowed in the pool area at any time.

Tobacco products: Smoking and use of tobacco products of any kind are prohibited in all areas of the pool or clubhouse.

Vandalism: Anyone caught vandalizing the pool or surrounding area will be suspended of pool privileges and will be held liable for the destruction and damage as may be determined by a Court of Law.

 Pool Behavior

Any personal conduct endangering safety of self and others are strictly prohibited. For the safety and enjoyment of the pool for all members, there can be No exceptions.

 Rowdyism or other conduct affecting the safety or comfort of others shall not be permitted.

Abusive, offensive, or profane language is not allowed. 

Swim safely and treat others as you would like to be treated.

 Food and Beverages

Food and alcoholic beverages are prohibited in the pool area. 

Liability

The Arboretum Community Association does not provide lifeguards at the pool. All persons using the pool and the facilities at any time do so at their own risk and sole responsibility. The Arboretum Homeowners’ Association assumes no responsibility for any accident or injury in connection with such uses or for any loss and/or damage to personal property. All persons using the pool or pool area agree not to hold the Arboretum Homeowners’ Association liable for any actions of whatever nature occurring within the pool area. 

Members will be responsible for all actions of their children and guests.  Parents and/or grandparents shall be fully responsible for their children or grandchildren at all times.

 Unclaimed articles will be disposed of after fourteen (14) days. The Association is not responsible for the theft or loss of any personal property of any member or guest-at the pool, deck, or in the clubhouse. 

Enforcement and Loss of Pool Privileges

Enforcement

All residents are responsible for enforcing the rules of the Arboretum Homeowners’ pool. Persons using the pool are responsible for observing conditions and reporting any unsafe conditions promptly to the Pool Personnel. All members and guests are required to abide by these rules in order to maintain a safe and clean place for our families to swim. Parents/grandparents are responsible for instructing their child or children to observe all rules.  Parents/grandparents are ultimately responsible for the conduct of their children and guests at the pool. 

Loss of Pool Privileges

The Board of Directors reserves the right to revoke any clubhouse card for dangerous acts, improper conduct, or severe or repeated violation of the rules.

 Any person or persons who shall destroy OT damage Pool property through gross carelessness or willful misconduct shall be held financially liable for such destruction or damage.
